It is being reported on January 10, 2017 that Rudy Guede’s petition to review his conviction as an accomplice to the murder of Meredith Kercher has been deemed “inadmissible”by the Florence appeals court. Rudy Guede is serving a 16-year sentence for the murder of Meredith Kercher. His two former co-defendants Amanda Knox and Raffaele Sollecito were acquitted in 2015 after doubt was cast on their DNA evidence.
An attorney for the Kercher family, Vieri Fabiani, stated that the Florence appeals court did not accept a petition to review his appeal because no new evidence had been presented. However, Guede’s legal team is considering taking Rudy Guede’s case to the Italian supreme Court of Cassation.
Last year Rudy Guede appeared on national Italian television and definitively announced that Amanda Knox was at the murder scene the night Meredith Kercher was murdered. Guede claims that he did not wield the knife in the stabbing death of Meredith Kercher.
“The defense of Guede, lawyers Pietrocarlo Thomas and Monica Grossi, had also called for the acquittal of Guede “for not having committed the crime” by highlighting the alleged incompatibility between the final judgment of the Supreme Court, which confirmed in 2010 Guede’s conviction for murder in collusion with others, and the Supreme Court judgment in 2015, that, however, acquitted Amanda Knox and Raffaele Sollecito.
“We are assessing whether to appeal to the Supreme Court”, “this appeal court decision is not the final word” in this story.
So, leaving the courtroom, the lawyer Thomas Pietrocarlo, defender Rudy Guede, commented to reporters on the decision of the Court of Appeal of Florence.
“The appeals court,” said the lawyer Pietrocarlo, “found that between the two decisons there is not even found, in the abstract overview planning [?] level, a contradiction or an incompatibility. However, it is quite evident in our view to be incompatible and the revision should be judged admissible.” In particular, “we believed that, since the Court of Cassation ruled that the one (Sollecito’s knife, ed) is not the murder weapon, that biological trace on the bra can not be attributed to Sollecito, here we thought that these findings of fact were incompatible with the condemnation (against Guede, ed) because that condemnation takes as legal fact that the knife was the murder weapon and the performance of sexual violence” on Meredith by Guede “was helped by Sollecito”. The Supreme Court, in acquitting Knox and Sollecito, “states, however,” Guede defense lawyer said, “that this is not true. In our view, the two were therefore judged incompatibly in the sense that these two positions on historical facts were at the basis of our” conviction, precisely one against Guede, became final in 2010, “they were instead established as not real by the Supreme Court” in acquittals of Knox and Sollecito
